MM2H Application and Terms & Conditions

Eligibility.

The Malaysia My Second Home (MM2H) programme is intended for people who want to retire in Malaysia or spend extended periods in the country. MM2H visa holders are not permitted to work in Malaysia. They will receive a multiple entry visa valid for ten years.
This visa will be renewed at the end of the ten years as long as the applicant has complied with the terms and conditions of the programme and the laws of Malaysia. However the initial term of the visa will only be valid up to the expiration date in the applicant’s passport and the balance will be given when they receive their new passport.  
All applicants are required to use an approved government agent to apply for the visa. A complete list of authorised agents can be found on the Ministry of Tourism website www.mm2h.gov.my. The government has advised agents they may charge up to RM10,000 for assisting with the visa application and collection.
People wanting to live in Sabah or Sarawak have to make their application to the immigration offices in those States.
The agent acts as the sponsor for the applicant.

Finance/Income

All applicants have to show they have sufficient income to support themselves in Malaysia without working here. In order to obtain the visa they will have to show documentary evidence of their regular income and other assets to show that they can cover their living costs in the country.
All applicants except those aged over 50 who have a government pension in excess of RM10,000 a month, are required to place a Fixed Deposit, in Malaysian Ringgit with a bank in Malaysia..
For people aged over 50 the Fixed Deposit is RM150,000, for those under 50 the amount is RM300,000. This deposit must remain with the selected bank until the person leaves the programme and earns interest. If a married couple apply the oldest person’s age decides the appropriate criteria.
After one year it is possible to withdraw part of the Fixed Deposit to cover the cost of buying a house, paying school fees or medical expenses. The expenditure must have been made after the MM2H visa was issued and at least RM60,000 must always remain on Fixed Deposit
 

The Application

The applicant does not have to be in Malaysia when the application is submitted. They only have to come once the application is approved, to collect the visa. The agent will assist with preparation of the application and ensure everything is in order.

A listing of documents required is shown below/in the box. (amend as appropriate). These are submitted to the Ministry of Tourism and are reviewed by a committee made up of staff from the Ministry of Tourism and the Department of Immigration. It usually takes about 60 to 90 days for them to review an application after it is submitted. If they approve the submission they will issue a letter of “conditional approval”.

In the event it is denied applicants are permitted to make an appeal with any additional supports necessary to support their request for reconsideration.

This conditional approval states the applications is approved subject to compliance with a few conditions. There are usually three conditions which have to be met before collecting the visa - arranging to open the Fixed Deposit account (unless this is waived), having a medical examination, (this must be done in Malaysia for every applicant) and arranging local medical insurance. The requirement for medical insurance can be waived if the applicant is declined due to their age (usually the case for people over 60).

Education

Applicants are allowed to bring along their dependants (children) either pre school or schooling in primary, secondary or in any Institution of higher Learning. Dependants who are schooling are also required to apply for a Student Pass to continue their education in schools or Institutions of Higher Learning recognised by the government. Children have to be aged under 18 to be included under the MM2H visa programme.

Taxes

Successful applicants are bound by the policies, systems and regulations of taxes of this country however their overseas income will not be taxed in Malaysia.

Restrictions

Successful applicants are not permitted to work in Malaysia. They can invest in businesses and be a Director of a local company. However their duties must be limited to attending board meetings and they cannot be involved in the day to day business.

Applicants are also not permitted to be involved in activities that can be considered as sensitive to the local people like political or missionary activities.

Making the Application

Effective June 1st 2007 all applicants are required to use an agent approved by the government. These can be identified by the initials (MM2H) in their company name.

Benefits of Living in Malaysia with MM2H visa

Living in Malaysia with a MM2H visa offer various benefits. Some of these are available to all foreigners regardless of their visa status, other are only for MM2H visa holders.

  • A renewable, ten year, multiple entry visa
  • One tax free car - either imported from the last place of residence or home country or purchased tax free in Malaysia.
  • No tax on overseas income brought into in Malaysia
  • No inheritance tax in Malaysia
  • Approval to bring in one maid from an approved country
  • Ability to purchase any number of residential properties priced above RM250,000. (This benefit is open to any foreigner even if they do not have a visa).
  • Access to local banking services like opening current accounts, home loans and local credit cards. These can be difficult to obtain without a visa to live in Malaysia.
  • Ability to educate children in international schools in Malaysia (some schools permit this without the person having a resident visa but it can be difficult)
